SJJ attorneys already established a policyholder’s ability to recover interest on an underpaid insurance claim when the policyholder is forced to resolve it through the appraisal process in 2017 before the Minnesota Supreme Court.  Since then, some insurance companies have tried to alter their policies in an attempt to prevent policyholders from receiving interest on these underpaid claims.

SJJ attorneys Anthony Remick and Tim Johnson recently argued against one of these altered policy provisions in Pleasure Creek Townhomes Homeowners’ Association v. American Family Ins. Co.  The Hon. Judge Melissa M. Saterbak of Anoka County District court agreed with SJJ that the new policy did not exclude the insured’s ability to recover interest.  Accordingly, the insured was awarded interest on their insurance claim.  This represents a substantial victory for Minnesota property owners.
