Anthony (“Tony”) T. Smith has been representing property owners for most of his career. His practice focuses on the diverse legal needs of homeowners associations (HOAs) in all aspects of their operation, including the following:

  • Contract review and negotiation
  • Insurance claim and coverage disputes

In addition to representing homeowners associations, Tony acts as general counsel to local, regional, and national community management companies and contractors, advising them on legal and operational matters, including:

  • Contract drafting, review, and negotiation
  • Risk management and insurance matters
  • Compliance with state and federal laws affecting management companies
  • Employment law issues and disputes
  • Vendor and contractor disputes
  • Litigation and appellate representation

Tony also has a banking and financial services practice, representing lenders and loan servicers in matters related to:

  • Association assessment lien priority and foreclosure disputes
  • Loan documentation and enforcement
  • Regulatory compliance
  • Collections and creditor rights litigation
  • Risk management in lending transactions involving common interest communities

An experienced litigator, Tony has tried multiple jury trials to verdict and has handled appeals in complex disputes in state and federal courts.

Tony is a skilled communicator, problem solver, and negotiator. He regularly presents educational seminars for CAI’s Colorado and Minnesota chapters and other professional organizations and was the 2022 President of CAI’s Minnesota chapter.

Tony also volunteers his time and experience as legal counsel for Rein In Sarcoma, a nonprofit organization dedicated to educating the public and medical community about sarcomas, supporting sarcoma patients and their loved ones, and funding research directed toward developing new treatments and finding a cure for sarcoma cancers.

Tony has been named a “Super Lawyer” by Law & Politics every year since 2018. Before that, he was named a Rising Star by Law & Politics from 2007-2015.
